Please join Winston & Strawn and the Federal Bar Association, SDNY Chapter, for a CLE program discussing the activation of Title III of the Helms-Burton Act and its implications for U.S. entities and interests in Cuba.

On April 17, 2019, the Trump administration announced for the first time since its enactment the activation of Title III of the Helms-Burton Act, which authorizes a private cause of action for any U.S. citizen whose land was nationalized or confiscated by the Cuban government as of 1959 to sue in U.S. courts any person or entity who “tracs” or economically benefits from their previously held property.

The statute’s expansive extraterritorial application allows for lawsuits against foreign companies engaged in business deemed lawful in Cuba, in their home countries and under international law to be subject to U.S. jurisdiction. As such, it has caused much concern. Indeed, some countries have already passed “blocking legislation” prohibiting cooperation with U.S. courts and pledging to fight any suits against their companies doing business in Cuba.
